With the rapid development of information technology at the present time, the means and forms of crime are more diverse. There are many difficulties in the protection of personal information in our country's criminal law, including unclear legislative provisions and judicial disputes. Criminal law is a very important part of the legal system. In part, it should actively play its role, improve legislation and justice in many aspects, and form a personal information protection system together with other laws.
This paper mainly hopes that through the relatively systematic research on the protection of personal information in criminal law, we can answer the following questions, including whether citizens’ personal information needs to be protected by criminal law, whether the protection of citizens’ personal information in criminal legislation is perfect, whether the protection of citizen’ personal information in criminal law is excessive, the boundaries of protection, and how to connect with other laws and other issues. In addition, based on the exploration of domestic and foreign regulations on the protection of personal information in criminal law, we can put forward some suggestions for the above questions, so as to make the regulation of personal information protection in the field of criminal law more perfect.
